China Gives Taiwan Authorities Stern Warning

Taipei given stern warning

Beijing yesterday issued a stern warning to Taipei on its push for
United Nations membership, saying that it has made "necessary
preparations" for dealing with any "serious situation".

The strongly-worded statement by the Taiwan Affairs Office of the State
Council followed a rally organized by Taiwan leader Chen Shui-bian
calling for a referendum to join the UN under the name of Taiwan - a
move that is considered a step toward "formal independence".

During the rally on Saturday, Chen tried to feverishly whip up support
for his "referendum" plan on the island's entry to the UN, and claimed
that "Taiwan is a sovereign state".

The Taiwan Affairs Office said in the statement that the situation at
the rally showed that Chen's "referendum" plan has failed to win the
support of the masses.

"We are keeping a close watch over developments on the other side of
the Straits and have made necessary preparations to cope with any
serious situation," the statement said.

Attempts by the Taiwan authorities to join the UN have twice been
rebuffed in the last two months even as Chen has been pushing his plan
to hold a "referendum" in Taiwan on its entry to the UN.

"The warning shows the mainland's firm determination to safeguard
national unity," said Zhu Weidong with the Institute of Taiwan Studies
affiliated to the Chinese Academy of Social Sciences.

Also yesterday, Foreign Ministry spokeswoman Jiang Yu urged the United
States to cancel its proposed arms sales to Taiwan immediately and stop
sending any "wrong signal" to secessionist forces on the island, Xinhua
reported.

The Pentagon announced tentative plans last week to sell surplus P-3C
Orion submarine-hunting aircraft and air-defense missiles to Taiwan.

"Referendum for UN membership" intolerable by law

Taiwan leader Chen Shui-bian has stepped up his scheme to promote a
"referendum" on the island's entry into the United Nations in recent
months, and he and his followers in the Democratic Progressive Party
(DPP) should know their actions are intolerable by law and those who
play with fire will get burned eventually.

Taiwan as part of China's sacred territories affirmed by international
law

Taiwan, as a sacred, inseparable part of Chinese territories since the
ancient times, has been proven by countless historical records,
archeological findsso far unearthed, the common ethnical language, the
culture, religion and local customs, as well as thekinship of people
across the Taiwan Strait.

It was once grabbed by Japan through an unequal treaty signed at the
end of the Sino-Japanese war of 1894-1895, which was launched by
Japanese forces to annex Korea and invade China, but was later
recovered and resumed as part of China again half a century later.

During World War II, the most intensified anti-fascist war, the Cairo
Declaration, was concluded by China, the U.S, and Britain on Dec. 1,
1943, which had declared that Chinese territories seized by Japan after
the outbreak of the First World War in 1914, including the four
provinces in northeast China then, Taiwan and Penghu islands, had to be
returned to China.

The Potsdam Proclamation reached by China, the U.S. and Britain on July
26, 1945 (subsequently adhered to by the former Soviet Union)

specified that "the terms of the Cairo Declaration shall be carried
out." On Sept. 2 of the same year, formal instruments of surrender
signed by Japanese officials on behalf of the Emperor noted that Japan
would faithfully and earnestly undertake the obligation of implementing
the terms of the Potsdam Proclamation.

The Cairo Declaration and the Potsdam Proclamation again announced the
reaffirmation that Taiwan was Chinese territory.

Therefore, the ceremony was held to accept Japan's surrender in Taiwan
province on October 25, 1945. From that point in time forward, the
Chinese government recovered Taiwan and Penghu islands and resumed the
exercise of sovereignty over them and, from that point in time forward,
Taiwan and Penghu islands had been put back under jurisdiction of
Chinese sovereignty.

In 1971, the 26th Session of the United Nations General Assembly
adopted with an overwhelming majority Resolution 2758, which restored
the legitimate right of the People's Republic of China (PRC)

in the UN, and its political legal implications were crystal clear,
which are based on a self-evident fact. That is, China is an integral
country, and Taiwan is part of it.

When China and Japan signed the Sino-Japanese joint statement in 1972
upon the normalization of their  diplomatic ties and concluded the
Sino-Japanese Peace and Friendship in 1978, the Japanese government
also reiterated once again that it will adhere to the stance of
observing the "Cairo Declaration" and the "Potsdam Proclamation".

To date, more than 160 countries worldwide having forged diplomatic
ties with China have all made it clear that Taiwan is part of China in
their joint communiqués of forging diplomatic ties with the country.

The UN Charter has 111 articles sub-divided into 19 chapters apart from
a preamble and a conclusion, and it especially underscores that only a
sovereign nation can apply for the UN membership. Through no complete
reunification across the Strait has been fulfilled since 1949, but
Taiwan being part of China has remained unaltered, both in effect or
legally. And Resolution 2758 of the UN General Assembly adopted in 1971
resolved China's legal status and, on this basis, the sole legal
representation of PRC was resumed at the UN.

Furthermore, any sovereign nation in the world does not permit any of
its provinces or regions to join the UN, which only recruit sovereign
nations and, as a matter of fact, not a single country has so far
permitted any of its provinces or regions to apply for the UN
membership. As what has been said, Taiwan represents only part of China
and it has never been a sovereign state and, fundamentally speaking, it
is not qualified to join the UN in any name.

Meanwhile, the UN Charter explicitly specifies that the United Nations
and any of its member nations are not entitled to meddle in the
domestic affairs of other countries.

A few countries, however, at the instigation of the Taiwan authority,
raised the so-called the issue relating to "Taiwan's application for UN
membership" and openly espoused "Taiwan independence", which is aimed
to trample upon the purpose and principles of the UN Charter and the UN
Resolution 2758 and grossly interfere with China's domestic affairs.
Since 1993, the so-called motion of "Taiwan''s returning to the UN" has
been rejected to be placed on the agenda of the General Assembly each
year.

Forceful promotion of "Referendum" sure to inflict grave consequences

In fact, any sovereign nation in the world never tolerates secessionist
moves. The United States passed the "Anti-Secession Act" in the sixties
of the 19th century.

In a bid to cope with the secessionist forces at home, the Supreme
Court in Canada passed a verdict in 1998 under which no province had
the right tobe ceded from the federation.

The people's self-determination in either the Canadian federal
constitution or in the International Law does not permit a province to
reach a decision to go independent.

Under the 1993 Russian Constitution, the Russian Federation stipulates
that the federal sovereignty applies to all its territories and that
the bulk of the federation power belongs to the Russian Federation.

To date, it has become an international conventional practice to
protect state sovereignty and territorial integrity through legislation.

In March 2005, China''s National People''s Congress (NPC) adopted the
Anti-Secessionist Law in strict compliance with the "Constitution of
PRC", which implied the utmost sincerity of the motherland to strive
for the prospects of peaceful reunification with the maximal effort not
to let anyone cede Taiwan from China by any means. If Chen Shui-bian
acts willfully with a reckless move, he has to bear all grave
consequences arising thereafter.

Chen Shui-bian's promotion of "Referendum" has seriously violated the
"one-China" principle established in the contemporary international
politics and laws, and the related consequences will only immediately
and seriously jeopardize Taiwan compatriots and the entire Chinese
nation.

For the sake of peaceful development and the well-being of people
across the Strait and the nation's future, countrymen from both sides
of the Taiwan Strait should get united to halt the reckless adventures
of the Chen Shui-bian regime for "Taiwan independence".
